JUDGEMENT

(1.) Rule. Heard learned Counsel for the parties.

(2.) The present petition seeks direction to the respondents to admit the petitioner in B.A.(Pass) course First year in Rajdhani College, New Delhi, respondents 1 and 2 herein.

(3.) The petitioner applied for admission in the above said college by filling up the necessary form for the Session 1996-97. The date of birth of the petitioner is shown as 30th May, 1976 and he was aged about 20 years at the time of submission of the form. The college is affiliated to the University of Delhi and released the third admission list on July 3, 1996 in which the petitioner was found eligible for admission his percentage of marks (62.5%) was above the cut-off percentage of 62 per cent. The petitioner was given admission Form No. 154 by the college and was told to come and deposit his fees on 4th July, 1996. However, when he approached the college to deposit his fees on that date he was told by the counter clerk that he could not be admitted as he was over age by 4 months. The entry "over age' was recorded on the form and the request of the petitioner to accept the fee was refused. Thereafter, the father of the petitioner Mr. Bir Singh complained to the University Authorities and it is alleged that the Deputy Dean, Students Welfare, Delhi University Mr. C.S. Dubey ordered the college Authorities in writing to admit the petitioner as there was no upper age limit according to the University rules. However, the petitioner did not succeed in getting the admission and after exhausting the usual remedy of sending legal notice, he has approached this Court by means of this writ petition.
