JUDGEMENT

(1.) THREE months parole is sought for the petitioner, who is undergoing sentence of life imprisonment for the offence under Section 302 IPC, for the purpose of repairing the house and arranging the marriage of his younger sister. A representation/request made by the petitioner to the State authorities in the year 2005 did not find favour and was rejected primarily on the ground that he had last availed of parole for a period of one month in the year May/June, 1998 and thereafter jumped parole and he could be apprehended only in January, 1999. Mr. Sumeet Verma, learned counsel for the petitioner has pointed out that any default committed by the petitioner in the year 1998/1999 should not come in his way after six/seven years in as much as he has remained in constant incarceration ever since his first parole.

IN the opinion of this Court, having regard to the facts and circumstances of the case that the petitioner has last availed of the concession of parole in the year 1998/1999, this Court is inclined to grant him parole for a period of four weeks with effect from the date of his release, of course, subject to the condition that he will execute a personal bond in the sum of Rs. 25,000/- with two sureties in the like amount to the satisfaction of the court concerned; and also subject to the verification of his residential address; and that if he is released on parole, he will report to the concerned police station on every Monday of the weeks.

(3.) ORDER be communicated to the petitioner through Superintendent Jail, Tihar. Petition partly allowed.
