The petitioner claims to have been appointed, on 23-1-1959, as Constable in the Delhi Police by the Deputy Inspector-General of Police, vide his appointment certificate (copy of which is Annexure-A to the petition). He was confirmed on 1-8-1964; after having qualified in the Departmental Test he was brought on the List 'C' (Clerical) for promotion to the rank of Head Constable w. e. f. 21-3-1964. It is further alleged that as approved and ordered by the Deputy Inspector General of Police (D. I. G.) and intimated by the Assistant Inspector General of Police, the petitioner was promoted to officiate as Head Constable (Ministerial) and granted special pay of Rs. 20/- w. e. f. 16-5-1964 (copies of which are Annexures B and C to the petition).
(2.) It was denied in the affidavit by Shri B. R. Rajgopal, Inspector General of Police, filed in opposition to this Writ Petition, that the appointment of the petitioner as Constable of Police was made by the D. I. G. of Police, but the further facts stated about his promotion (by the D. I. G.) as Head Constable and being granted special pay were admitted in the said return.

It is also claimed by the petitioner that there was not even a single bad or adverse entry against him but, on the contrary, he earned 27 Commendation Certificates during his service period of about 9 years in the Delhi Police Department. Sometime in 1965 sanction had been granted by the Central Government to form the Delhi Police Non-Gazetted Karamchari Sangh. A Commission was also set up under the Chairmanship of Shri G. D Khosla, retired Chief Justice of the High Court of Punjab, to investigate and report on the grievances of Delhi Police. It was alleged that the Government, which was not reconciled to the formation of the Sangh, wanted to bring down the Sangh by dismissing the leaders of the Sangh who were serving on the Executive Committee and arresting and terminating the services of hundreds of other Police men who were active members of the Sangh during the Delhi Police agitation of April, 1967.
