RAKESH KUMAR Vs. STATE OF NCT OF DELHI

JUDGEMENT

(1.) This is a petition under Sec. 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking quashing of FIR No. SEO-NFC-000690, dtd. 16/10/2023, registered at e-P.S New Friends Colony, South East under Sec. 379 IPC and all proceedings emanating therefrom on the basis of settlement between the parties.

(2.) The Respondent No.2 reported the theft of his cheque book pertaining to A/c No. 10569603032 in SBI, Nirman Bhawan Branch which he suspects was stolen from his bag while he was at Sukhdev Vihar, New Delhi. Two Cheques bearing No. 052256 and 052257 from the said cheque book, each amounting to Rs.20,000.00 drawn on SBI, Nirman Bhawan Branch, New Delhi were missing. The Respondent No.2 lodged the aforesaid FIR under Sec. 379 IPC on 16/10/2023 based on the information received through an e-FIR.

(3.) During the proceedings, the parties amicably resolved their disputes and executed a Settlement Agreement dtd. 10/3/2025. In pursuance of the Settlement, the Petitioner has paid Rs.35,000.00 in lump sum cash to the Respondent No.2 as full and final settlement. It is submitted that all the previous complaint and litigation initiated by the parties has been withdrawn. The copy of Settlement Agreement dtd. 10/3/2025 has been placed on record as Annexure P-3.
