The present petition under Sec. 482 Cr.P.C. has been filed by the petitioners, namely, Sh.Pankaj Bhardwaj, Sh.Suresh, Sh.Monu and Sh.Manish Bhardwaj for quashing of FIR No. 200/2013 dated 16.06.2013, under Ss. 304/323/452/34 IPC registered at Police Station Rani Bagh on the basis of the mediation report arrived at the Mediation Centre, Rohini Courts, Delhi between the petitioners and respondent no.2, namely, Sh. Satish Kumar at New Delhi on 19.11.2013.
(2.) Learned Additional Public Prosecutor for respondent -State submitted that the respondent no.2, present in the Court has been identified to be the complainant/first -informant of the FIR in question by the SI Parveen Ahlawat.
(3.) Respondent No. 2 present in the Court, submitted that the dispute between the parties has been amicably resolved. As per the report, it has been agreed that petitioners shall relinquish rights to recover any amount from the respondent no.2 in full and final settlement of the present case. The respondent no.2 agreed to cooperate in the quashing of the FIR in question. It was further agreed that the quashing petition shall be moved within a month from the date of settlement. It has been stated that another complaint, which was filed earlier has already been withdrawn. It has also been agreed that after the quashing of the FIR in question, the petitioners shall withdraw the suit from the Ld. Referral Court. Statement of Mr. Satish Kumar - respondent no.2 was recorded in the Suit No. 310/13 in which he stated that he is making the statement voluntarily and he has entered into a compromise with the petitioners before the mediation centre. Respondent affirm the contents of the aforesaid report and of his affidavit dated 16.12.2013. In the affidavit, the respondent no.2 has stated that he has no objection if the FIR in question is quashed. All the disputes and differences have been resolved through mutual consent. Now no dispute with petitioners survives and so, the proceedings arising out of the FIR in question be brought to an end. Statement of the respondent No. 2 has been recorded in this regard in which he stated that he has entered into a compromise with the petitioners and has settled all the disputes with them. He further stated that he has no objection if the FIR in question is quashed.
