(1.) Petitioner is in incarceration for about six years. He is facing life sentence. His jail conduct is satisfactory as is evident from a perusal of nominal roll. He seeks parole on the ground that he intends to file a Special Leave Petition in the Supreme Court and further that he is desirous of maintaining social ties with his family and friends. Prayer of petitioner for his release on parole has been rejected by the Government of N.C.T. of Delhi on the ground of adverse police report to the effect that law and order problem may arise if petitioner is released on parole. What is the basis of forming such an opinion, has not been spelled out in the impugned order nor in the status report. Address of the petitioner has been verified. I am of the view that every convict/accused is entitled to exhaust all the legal remedies as may be available to him upto the highest fora. It is also trite law that in case a prisoner in long incarceration is released on parole to maintain social ties and blend himself in the mainstream of society, it aids to his mental and physical well-being. In the facts and circumstances of the case, petitioner is ordered to be released on parole for a period of one month from the date of his release, subject to his furnishing a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand Only) with one surety in the like amount to the satisfaction of the Jail Superintendent. During the parole period, petitioner shall not leave the territorial bounds of Delhi and shall report to Station House Officer, P.S. Patel Nagar, Delhi once a week, that is, on Monday at 10 AM. He shall also provide his contact number to the Station House Officer. On completion of the parole period, petitioner shall surrender before the Jail Superintendent. Copy of this order be sent to Jail Superintendent for serving it on the petitioner and also for compliance. Writ petition is disposed of in the above terms.
