JUDGEMENT

(1.) The present petition under Section 482 Cr.P.C. has been filed by the petitioners, namely, Sh. Rajender Karotia, Sh. Rakesh, Sh. Ajit @ Amit, Kumari Reena and Rahul @ Sudhir for quashing of FIR No.362/2015 dated 09.04.2015, under Sections 308/323/506/34 IPC registered at Police Station Ambedkar Nagar on the basis of compromise deed arrived at between the petitioners and respondent nos. 2, 3 & 4, namely, Shokin Khan @ Shokat, Rekha @ Reshma and Anish @ Unish Khan at New Delhi on 12.08.2015.

(2.) Learned Additional Public Prosecutor for respondent-State submitted that the respondent no.2, present in the Court has been identified to be the complainant/first-informant of the FIR in question and respondent nos.3 and 4 to be the victims in the present petition by the SI Ram Singh.

(3.) Respondent Nos.2 to 4 present in the Court, submitted that the dispute between the parties has been amicably resolved. As per the settlement deed, the respondent nos.2 to 4 have no grievance or grudges against the petitioners. Further it has been stated in the deed that the petitioners shall pay a sum of Rs.1,75,000/- as compensation as full and final settlement for the injuries suffered by respondent nos. 2 to 4. The matter has been compromised between the parties with the intervention of the respectable members of the society and their advocate. It has also been agreed between the parties that the respondents will co-operate with the petitioners in the quashing of the FIR in question and that after quashing of the FIR in question, the respondents will not file any kind of case against any of the petitioners. Respondents affirm the contents of the aforesaid compromise deed and respondent no.2 also affirms the content of his affidavit dated 24.08.2015 supporting this petition. In his affidavit the respondent no.2 has stated that he has no objection if the FIR in question is quashed. All the disputes and differences have been resolved through mutual consent. Now no dispute with petitioners survives and so, the proceedings arising out of the FIR in question be brought to an end. Statements of the respondent Nos.2, 3 & 4 have been recorded in this regard in which they stated that they have entered into a compromise with the petitioners and have settled all the disputes with them. They further stated that they have no objection if the FIR in question is quashed.
