BY way of this petition filed under Section 482 of the Code of Criminal Procedure, 1973, petitioners seek quashing of FIR No. 287/2013 registered at Police Station Lajpat Nagar for the offences punishable under Sections 498A/406/34 IPC and the consequential proceedings emanating therefrom against the petitioners on the ground that the matter has been amicably settled between the parties.

LEARNED counsel appearing on behalf of the petitioners submits that the aforesaid case was registered on the complaint of respondent No. 2, Ms. Reenu Rana, consequent upon certain matrimonial and domestic disputes that have arisen between the parties pursuant to her marriage dated 16.02.2010 with the petitioner No. 1 Amit Chauhan. After investigation, police has filed the chargesheet. However, in the meantime, the parties have amicably settled their disputes vide settlement dated 02.01.2014 arrived before the Mediation and Conciliation Center, Saket Courts, New Delhi, and accordingly, the marriage between the petitioner No. 1 and the respondent No. 2 has been annulled by a decree of divorce dated 22.12.2014. Copies of the settlement arrived at between the parties and the decree sheet noted above are annexed to the present petition.

LEARNED Additional Public Prosecutor appearing on behalf of the State submits that since the matter pertains to domestic and matrimonial dispute, parties have amicably settled the matter, obtained divorce by mutual consent and the complainant is no longer interested in supporting the prosecution, therefore, looking to the overall circumstances, no useful purpose will be served in continuing the proceedings. Thus, the State has no objection if the present petition is allowed.
