The present petition under Section 482 Cr.P.C. has been filed by the petitioners, namely, Sh.Ravi Kumar, Sh.Pawan, Sh.Sanjay Kumar and Sh.Pushap Kumar for quashing of FIR No.156/2012 dated 11.06.2012, under Sections 307/435/34 IPC registered at Police Station Shalimar Bagh on the basis of compromise arrived at between the petitioners and respondent no.2, namely, Sh. Ravi Prakash on 28.05.2015.
(2.) As per the compromise deed, the parties have entered into a compromise and have no complaint against each other. The parties have settled the matter amicably. It was also agreed that the accused shall institute a quashing petition for quashing the FIR in question. Respondent No.2 has placed on record his affidavit dated 18.09.2015. In his affidavit, it has been stated he has compromised the matter without any fear, force or pressure and that all the disputes and differences have been resolved through mutual consent, thus he has no objection if FIR in question is quashed. Now no dispute remains between the respondent no.2 and the petitioners and so, the proceedings arising out of the FIR in question be brought to an end.
(3.) In Gian Singh v. State of Punjab, 2012 10 SCC 303 Apex Court has recognized the need of amicable resolution of disputes in cases like the instant one, by observing as under:-
