PROGRESSIVE SHELTERS PVT LTD & ORS Vs. STATE

JUDGEMENT

(1.) Vide the instant petition; petitioners seek directions thereby quashing FIR No. 148/2013, registered at PS-Barakhamba Road for the offences punishable under Section 420 IPC against the petitioners which is now pending investigation with ALBR Section, EOW, Crime Branch, Delhi Police, PS-Mandir Marg Complex, Mandir Marg, New Delhi.

(2.) Ld. Counsel appearing on behalf of the petitioners submits that the aforesaid case was registered on the complaint of respondent no. 2 / BLS SUMER JV through its authorised representative, Sh. Dinesh Sharma. The case is at the initial stage of investigation. Meanwhile, the matter has been settled between the petitioners / Company and respondent no. 2 vide MOU dated 30.06.2015, which is at Page 57 of the paper book and as per the settlement the agreed amount has been received by respondent no.2/Company. Thus, respondent no. 2/Company does not want to pursue the case further against the petitioners/Company.

(3.) Mr. Dinesh Sharma, Authorized Representative of the Respondent no. 2/Company is personally present in the Court. The authority letter in this respect is at page 52. He has been identified by Inspr. S.N. Chaudhary, ALBR Section, EWO, Crime Branch. Mr. Dinesh Sharma, Authorized Representative of the Company submits that a settlement has been arrived at between the petitioners / Company and respondent no. 2/Company vide memorandum of settlement dated 30.06.2015 and a supporting affidavit thereto is also annexed with the petition. He further submits that the respondent / Company has received the agreed amount and does not want to pursue the case further against the petitioners / Company. Therefore, respondent no. 2 has no objection if the present petition is allowed.
