JUDGEMENT

(1.) Four persons, Mool Chand, Dal Kishan, Yashpal and the appellant Ved Ram came to be tried for various offences before Mrs. S. Duggal, AddI. Sessions Judge, Delhi, who finally acquitted Mool Chand. Dal Kishan and Yashpal but found the appellant Ved Ram guilty of an offence under Section 302, Indian Penal Code and sentenced him to undergo imprisonment for life. The present appeal has been filed by said Ved Ram against this conviction and sentence.

(2.) On 12th February 1981, police post Sun Light Colony was informed of some quarrel taking place near Anguri Mandir at Kitokari village in pursuance of which Sub-Inspector S.P. Rana P.W. 27 proceeded on spot accompanied by constables Bharam Singh and Islamuddin P.W. 18 and P.W. 22 respectively. They came across the complainant Vinod Kumar P.W.1.

(3.) P.W. 1 Vinod Kumar, who is the brother of deceased Vishal Kumar, made a statement before S. P. Rana Sub-Inspector stating that he together with his brothers Virender Kumar P.W. 2, Vinay Kumar P.W.6 and Vishal Kumar deceased was residing in house No. 107 Kilokari village and that about a month and a half before the date of incident the accused Dal Kishan and Yashpal had beaten the deceased Vishal on the pretext that he has teased the daughter of Ved Ram when she was on her way to school. He stated that accused persons on this account were harbouring ill will against Vishal; that on the date of incident i.e. 12-2-1981 while the marriage of Kasturi Lals daughter was being celebrated in the Park opposite Anguri Mandir and while be was present in his house alongwith Vinay, some children informed him at about 9.45 p.m. that his brother Visshal deceased was being beaten by Ved Ram and Mool Chand near Anguri Mandir. He further stated that he along with his brother Vinay Kumar rushed to the scene and found that Ved Ram and Mool Chand were beating Vishal with fist blows. They intervened and separated the parties and took their brother Vishal deceased to their home.
