Present writ petition has been filed under Article 226 of the Constitution of India seeking a direction to the respondent no.1/Registrar, Co-operative Societies (for short 'RCS') to complete the formalities for possession of "A" type flat to the petitioner and a direction to the respondent no.l/RCS and respondent no.3/Delhi Development Authority (DDA) to deliver physical possession of Flat No.570/A-432 to the petitioner.
(2.) The facts, shorn of unnecessary details and germane to the issue at hand, are as under:-

Mr. Sandeep Kumar, learned counsel appearing for the respondent no.2/Society argued that in the present case, even the mother of the petitioner, who is stated to have enrolled as a member in the year 1986 was herself not a resident of GNCT of Delhi, hence transfer of such membership in favour of the petitioner in the year 1991, would not confer any rights upon the petitioner. According to him, if the membership of the mother was defective, by no stretch of imagination could the transfer of a defective membership confer a lawful right of membership to the petitioner.
