JUDGEMENT

(1.) RESPONDENT was appointed as an Assistant Teacher under the petitioner on October 12, 1970 and with effect from January 01, 1973 was placed in the selection grade. With the implementation of the recommendations of the 4th Central Pay Commission, with effect from January 01, 1986, her salary was fixed in the replacement pay scale of Rs.1400 ­ 2600. We highlight. This was the replacement selection grade pay scale of Assistant Teachers.

(2.) ON March 18, 1994, the respondent was promoted as a Headmistress, pay scale whereof was the same as that of Assistant Teachers in selection grade i.e. Rs.1400 ­ 2600. At the relevant time FR- 22(I)(a)(1) was in the statute book. It read as under:-

(3.) TO put it simply, one increment in the time-scale of pay in the promotional post has to be given.
