JUDGEMENT

(1.) is Letters Patent Appeal is preferred by the appellants against the order dated 5th May, 2003 passed by the learned Single Judge of this court in CMs.3921 & 4185/2003 in CWP No.1669/2000. It is a short order and it is necessary to reproduce the same in entirety. The order reads as under:

(2.) It is amply clear that it is a consent order. Still appeal is preferred by the appellants. The main plank of challenge to the order is that arrangement agreed to among the parties, as reflected in the aforesaid order, goes contrary to the directions given by the Apex Court in the case of B.L.Wadhera Vs. Union of India reported in (1996) 2 SCC 594. It is because of this nature of challenge to the order that we heard all the parties at length.

(3.) In order to appreciate the challenge, it would be necessary to take note of facts and circumstances under which order dated 5th May, 2003 came to be passed.
