(2.) MR. V.K. Shali, Standing Counsel for the NCT of Delhi has filed the affidavit of Shri T.N. Mohan, Deputy Commissioner of Police (PHQ) in compliance with the order passed by this court on 27th November, 2002. By the said order authorities were asked to specify as to whether or not the construction of the police station and fire station has been raised with the approval of the competent authorities i.e. M.C.D., A.S.I. and Delhi Urban Arts Commission. In response to the same, DCP (Headquarter) in his affidavit has indicated that the police station and the fire station are being constructed in accordance with the layout plan and having plans duly sanctioned by the D.D.A. That the said plans have already been approved by the Delhi Urban Arts Commission, PWD, Division No. 12. They have also incor- porated the fire safety measures which is annexed along with the necessary sanction letter. That the buildings of the police station and the fire station are being raised in accordance with the sanctioned plans. The original file has also been produced which is scrutinized by us. From perusal of the file it is clear that the construction of the police station and the fire station are with the concurrence and approval of the competent authorities including A.S.I. During discussion for approval of plans Shri Chander Bhatia of A.S.I. was also present. Since the constructions are being carried according to approved plans we see no reason not to permit the authorities to carry out the construction of the police station and the fire station as per the sanctioned plans. We order accordingly. So far as the encroachments are concerned, it is stated that the DDA has already removed nearly 1700 unauthorised structure/encroachment around Jama Masjid. MR. Anil Grover, Standing Counsel for the MCD says that the plan has been chalked out to remove the unauthorised construction/enroachments and unauthorised squatting around Jama Masjid within three months. So far as the parking place is concerned, no construction is being carried on SHO Jama Masjid who is present says only levelling of the ground has been done but no construction has been raised. In view of above, nothing survives in the petition. It stands disposed off.
