(2.) The present petition has been filed by the Petitioner- M/s. Blue Heaven Cosmetics Pvt. Ltd. under Ss. 47, 57 and 125 of the Trade Marks Act, 1999 (hereinafter "Act") seeking cancellation/rectification of the following trademark/device mark/label pronounced as 'MARC HEAVEN' -

(3.) The impugned mark is registered in the favour of the Respondent No.1- Mr. Deepak Arora, bearing trade mark application no.4111088 in Class - 03 from 8/3/2019.
