The facts giving rise to this revision petition are that Shri Virender Singh (hereinafter referred to as the petitioner) was prosecuted under S. 3 of the Rly Property (unlawful possession) Act, 1966 and was convicted and sentenced to undergo R.I. for one year and also to pay a fine of Rs. 1,000.00 and in default to undergo further simple imprisonment for three months under Section 3 of the said Act. His appeal before the Addl Sessions Judge was dismissed by order dated February 5, 1982.
(2.) Aggrieved, this revision petition has been filed by the petitioner challenging the order of the Addl Sessions Judge.

Both the courts below after perusing the evidence on record, the alleged confessional statement of the petitioner recorded by an officer of Railway Protection Force and other circumstances came to the conclusion that the petitioner on October 19, 1977 at about 9.00 p.m. at the mineral siding gate was found in possession of 37 pig iron slabs weighing 17 quintals which was a stolen railway property loaded in his truck No. DLG 8200.
