(1.) This appeal by Promila Kumari is directed against the judgment and order dated 11th March, 1980 of Shri S.R. Goel, Additional District Judge, Delhi, rejecting her petition for annulment of marriage under Sec. 12 of the Hindu Marriage Act, 1955 (to be referred to as "the Act").
(2.) The appellant Promila was married to the respondent, Krishan Kumar Malhotra on 15th April, 1976 at Delhi in accordance with Hindu rites and ceremonies. At that time Promila was about 24 years old and Krishan Kumar 36 years old; she was working as a tracer in the office of the Central Electricity Authority, R.K. Puram, West Block, New Delhi and he was working as a Technical Assistant in the National Council for Co-operative Training, South Patel Nagar, New Delhi.
(3.) After marriage, they lived together at Delhi with the rest of his family at 119/5, Railway Colony, Minto Bridge, New Delhi. On 24th April, 1976, they went to Simla for a holiday and returned to Delhi on 30th April, 1976. Therefore on 18th May, 1976, Promila went to stay with her family which also resided in Delhi. She returned to her matrimonial home on 21st July, 1976 on the insistence of Krishan Kumar's sister, Satya. However, once again on 9th Sept., 1976 she left the matrimonial home and never returned. On 7th Oct., 1976, she filed the petition under Sec. 12 of the Act.
