JUDGEMENT

(1.) In April 1967 Shri K. Krishnamurthy, the petitioner in this case, was working as Telegraph Master in the International Telegraph Office, New Delhi. Delhi Circle. In pursuance of orders issued by the Government of India, in the Department of Communications (P. and T. Board), dated April 22, 1967, the Deputy General Manager (Administration), issued Memo No. STB-2-Offtg/67/18, which was as follows:-

(2.) Shri K. Krishnamurthy, however, did not want to be transferred to Villupuram in Madras Circle. On the allegations that he could not be transferred outside his circle and that the transfer order was vindictive and mala fide he filed a petition, on June 28. 1967, to have the transfer order quashed.

(3.) The petitioner had joined service as a clerk in the Central Telegraph Office, Madras, on July 28, 1941. On Nov. 26, 1944 he was promoted as Telegraphist in the Central Telegraph Office, Madras, Madras Circle, and was also confirmed on that post from the same date.
