MITRASEN Vs. UNION OF INDIA (UOI) AND ORS.

JUDGEMENT

(1.) THE Petitioner who is a Constable with the Indo Tibetan Border Police assails an order dated 29th May, 2010 whereby he has been transferred from the 3rd Battalion of the Border Security Force, Karera located at Shivpuri in Madhya Pradesh to the 5th Battalion posted at Leh, Ladakh. The Petitioner also prays for directions to the Respondents to recall the movement order dated 10th July, 2010 issued pursuant thereto.

(2.) IN support of the writ petition, the Petitioner has pleaded medical grounds and urged that he is undergoing treatment. It is urged that assignment of lighter duties had been medically advised. It is contended that the Petitioner had sent a representation dated 29th May, 2010 to the Respondents and no response thereto has been received.

(3.) SO far as preliminary objection with regard to jurisdiction is concerned, having regard to the directions we propose to make, the same is not examined any further. The same is left open for consideration.
