JUDGEMENT

(1.) Challenge in this petition is to the order dated 29.07.2019 whereby the petitioner has been attached from Govt. Higher Secondary School, Kudekela to Govt. Higher Secondary School, Sisringa within the same Block.

(2.) Learned counsel for the petitioner submits that, the distance between the two place is 75 KM. Moreover, the counsel for the petitioner submits that the impugned order has been passed at the behest of the local MLA as is evident from Annexure P/2. He further submits that there is total ban on attachment as per the circulars of the State Govt. inspite of that the respondents have attached the services of the petitioner from one School to another School.

Given the aforesaid facts, let the petitioner make a detailed representation in this regard to the respondent No.2 within a period of 10 days from today and the respondent No.2, in turn, shall pass a fresh order considering the circulars of the State Govt. so far as attachment is concerned. Till the representation of the petitioner is decided by the respondent No.2, the effect and operation of the order dated 29.07.2019 and any relieving order based on that shall not be given effect to.
