(1.) Three appeals have been preferred against a common order dated 25.01.2018 passed by the learned Single Judge since three writ petitions were coupled together and heard together.
(2.) An advertisement was issued by the State Government for appointment on the post of Patwari. These Appellants applied, participated in the examination process including interview and counselling. But, despite being successful, their candidature have been rejected by the Respondent authorities on the ground that they do not possess educational qualification which is Post Graduation Diploma in Computer Application; hereinafter referred to as 'PGDCA'. Such a rejection became the reason for preferring the writ applications. The unified submissions on behalf of the Appellants is that the learned Single Judge, applying a wrong principle of law dismissed all the three applications, primarily on the ground that once these Appellants have participated in the examination process and having failed, they cannot claim any relief by challenging their failure on one ground or the other.
(3.) The fact is that none of the conditions of the advertisement are under challenge. It is in the manner in which the interpretations ought to be given with regard to the diploma, which these Appellants possess from a recognized private University of the State which is the reason arising for the dispute. The Respondents insist that since they have obtained a one year diploma from private Universities known as Dr. C.V. Raman University and MATS University, it should have been post graduation diploma in computer application and not mere one year diploma.
