JUDGEMENT

(1.) Fixed date S.P.C. was issued to respondents No. 8 to 9 vide order dated 4th April, 2008.

(2.) This appeal pertains to the year 1997 and is heard finally today.

(3.) In this appeal by the insurer, the award dated 5th March, 1997 passed by the 4th Additional Motor Accidents Claims Tribunal, Raipur (henceforth 'the Tribunal') in Claim Case No. 37/95 is under challenge whereby the Tribunal has awarded compensation of Rs. 1,11,000.00 against the appellant-insurer despite recording a finding that respondent No. 8 herein i.e. the driver of truck No. M.B.K. 7965 (henceforth 'the truck') did not possess a valid driving licence.
