JUDGEMENT

(1.) HEARD .

(2.) THESE are the 3 bail applications filed under section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants, who have been arrested in connection with Crime No. 200/2005, registered at Police Station Bhatapara, Distt. Raipur (C.G.), for the offence punishable under Section 302/34 of IPC. The case of the prosecution is that on 2-10-2005 at about 6.30 a.m., the dead body of the deceased namely Jaynum Musalman was seen in the canal near the township of Bhatapara. The report was lodged to the Police Station and the investigation commenced. During the course of investigation, memorandums of all the accused persons u/s 27 of the Evidence Act were recorded and articles like Lathi, Sickle and Wire were seized from their possession. Learned State counsel submits that the aforesaid articles alongwith the clothes seized from the possession of the applicants were also sent for chemical examination and the report of the Chemical Examiner has been received which states that the articles were stained with blood. However, there is no indication whether they were the human blood stains or the blood stains of the other genus. There is no report about the group test etc.

LET the applicants Dinesh @ Soda Verma; Janak Ram @ Nanchun Sahu; Dayawant @ Gajju Verma; Raj Kumar @ Guddu Yadav ; Sushila Bai Nishad and Chhedu Ram Sahu be released on bail on each of them furnishing a personal bond in sum of Rs. 10,000/- with one surety each in the like amount to the satisfaction of the trial Court for their appearance before the said Court on each date of hearing till the disposal of the trial. In the result, M.Cr.C. No. 2854/2005, M.Cr.C. No. 2856/2005 and M.Cr.C. No. 2894/2005 are allowed. Bail Granted.
