HARPRASAD PRADHAN Vs. STATE OF CHHATTISGARH

JUDGEMENT

(1.) Learned counsel for the petitioner would submit that the issue raised in this writ petition is squarely covered by the decision of this Court in the case of Shashi Bhushan Rathore vs. State of Chhattisgarh and others (WPS No.8861 of 2025 decided on 29/8/2025 wherein this Court has passed the following order. "Accordingly, this Court is of the opinion that the order dtd. 27/5/2025 is liable to be and is hereby quashed. The appellate authority - respondent No.3 is directed to decide the departmental appeal of the petitioner in accordance with law on its own merits under the applicable rules and circulars of the State Government governing the field by passing a reasoned order under the facts and circumstances of the case after affording proper opportunity of hearing to the petitioner within a period of two months from the date of receipt of a copy of this order. The petitioner is directed to produce a copy of this order to respondent No.3 within two weeks from today."

(2.) He would further submit that the present writ petition may be disposed of in the same terms, to which learned State counsel has no objection.

(3.) Accordingly, the writ petition is disposed of in terms of the order passed by this Court in the case of Shashi Bhushan Rathore (supra).
