JUDGEMENT

(1.) Heard. The first bail application bearing MCRC No. 8474 of 2020 was dismissed vide order dtd. 20/1/2021.

(2.) This is the Second Bail Application filed under Sec. 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 2/7/2020 in connection with Crime No. 186/2020 registered at Police Station- Kotwali, Balodabazar, District Bhatapara C.G. for the offence punishable under Ss. 394, 328, 395, 398, 120-B, 412 of IPC and Sec. 25 & 27 of Arms Act.

(3.) As per the prosecution case, the applicant along with other coaccused on 7/3/2020 at 09.00PM got lift in the truck of the complainant- Driver Ajit Kumar and at Nandghat Highway road forcibly took possession of the said truck bearing No. CG04-LE 5033 on the gun point and looted 33.570 tonnes of sponge iron loaded in it. On report being lodged to the above effect, offence under the aforesaid Sec. has been registered against the applicant.
