(1.) Heard on I.A. No. 01/13, an application for suspension of sentence and grant of bail to the appellant, Phool Singh during pendency of this appeal. The appellant has been convicted under Section 363, 366 and 376 of IPC and sentenced to undergo R.I. for 3 years and fine of Rs. 200/-, in default of payment of fine further R.I. for 1 month, R.I. for 4 years and fine of Rs. 300/-, in default of payment of fine further R.I. for 2 months and R.I. for 7 years and fine of Rs. 500/-, in default of payment of fine further R.I. for 8 months respectively with a direction to runs sentences concurrently.
(2.) Learned counsel for the appellant submits that the applicant is in jail since 21.07.2012 and he is ready to furnish adequate security and shall abide by all the directions and conditions which may be imposed by this Hon'ble Court.

Taking into account of the statement of the prosecutrix (PW-3) and Dr. Anita Verma (PW-7) and also considering that the appeal may take sometime for hearing, I am of the opinion that present is a fit case to suspend the jail sentences awarded to the appellant. Accordingly, I.A. No. 1 is allowed. It is directed that if the appellant deposits the entire fine amount and furnishes a personal bond for a sum of Rs. 10,000/- with two solvent sureties of the like amount to the satisfaction of the concerned trial Court, execution of the jail sentences imposed upon him shall remain suspended during pendency of this appeal and he shall be released on bail. He shall appear before the Registry of this Court on 22nd January, 2014. Thereafter, he shall appear before the concerned trial Court on a date to be given by the Registry of this Court and continue to appear there on all such subsequent dates as are given to him by the trial Court, till disposal of this appeal.
