(1.) Heard Mr. P.R.Patankar, learned counsel for the appellants. Also heard Mr. K.N.Nande, learned counsel for the respondent/writ petitioner.
(2.) The mother of the writ petitioner, namely, Smt. Prafulla Minj, who was working with the appellant-Bank as an Office Assistant, died-inharness on 24/9/2005. The petitioner moved an application for compassionate appointment on 28/3/2006. The appellant No. 2 issued a letter dtd. 24/8/2011 sanctioning an ex-gratia amount of Rs.7,00,000.00 which was directed to be kept in the Fixed Deposit in the name of the writ petitioner and his sister, indicating therein that the said amount will be disbursed only after the order is passed by the Hon'ble High Court, without indicating as to what order of the High Court has been referred to. As the amount was not disbursed to the petitioner and/ or his sister, a letter was written by him and his sister, namely, Chhayanjali Minj, to the Governor of Chhattisgarh on 14/2/2015, complaining about non-grant of compassionate appointment. In response to the said letter, the appellants issued a communication dtd. 27/2/2015 informing the petitioner that an amount of Rs.7,00,000.00 was sanctioned towards ex-gratia and deposited in the fixed account but disbursal of the same was subject to the order passed by the Hon'ble High Court. In the said communication, it was also informed that there was no provision for grant of appointment on compassionate basis.
(3.) Praying for setting aside the letter dtd. 27/2/2015 and seeking a writ of mandamus directing the appellants to consider and grant compassionate appointment to the petitioner, the writ petition came to be filed.
