JUDGEMENT

(1.) BY this petition, the petitioner seeks to quash the select list dated 02.05.2011 (Annexure P/1) issued by the Chhattisgarh Public Service Commission (for short "the P.S.C.") and the respondent authorities be directed to issue fresh select list for the post of Lecturer (Shalya Tantra) by considering the marks obtained by the petitioner in the interview.

LEARNED counsel appearing for the petitioner submits that pursuant to the advertisement dated 27.08.2009 (Annexure P/2) the petitioner along with other candidates applied for the posts advertised in the said advertisement. The last date for submitting the application form along with the certificates to indicate possession of requisite qualification was 3-10-2009. After scrutinizing the application forms, on 22-1-2011 (Annexure - P/3) the P.S.C. issued call letters to the eligible candidates to appear in the interview on 21.02.2011 along with the certificates. Thereafter, the P.S.C. issued the list of marks obtained by the candidates vide Annexure - P/4. In the said list, the name of the petitioner find place at S.No.3. Subsequently, the P.S.C. issued the selection list on 02.05.2011 (Annexure P/1) in which the respondents No.4 and 5 have been selected for the post of Lecturer (Shalya Tantra) in spite of the fact that they are not having the requisite qualification on the date of submitting the application form before the P.S.C.

(3.) THOUGH the facts are same in case of the respondent No.5 also, however, none appeared despite service of notice on behalf of the respondent No.5.
