GEETANJALI KUJUR Vs. STATE OF CHHATTISGARH & OTHERS.

Decided On June 28, 2012
Geetanjali Kujur Appellant
V/S
State Of Chhattisgarh And Others. Respondents

JUDGEMENT

(1.) W. P. (S) Nos. 957, 959 and 960 of 2011 are being disposed of by this common order as the point involved in these petitions is the same. However, for the purpose of adjudication of these petitions. reference is made to the facts mentioned in W.P. (S) No. 957/2011 (Kumari Geetanjali v. State of C.G. and others).

(2.) The facts, in brief, leading to filing of these petitions. are that the petitioner applied for selection and appointment on the post of Shiksha Karmi Grade-III, in Arts category in Janpad Panchayat Sitapur, District Sarguja pursuant to the advertisement dated 03.10.2009 (Annexure P-1) issued by the respondent No. 4 wherein the last date for making application was 6.11.2009 and date of examination was 29.11.2009. Thereafter, the petitioner appeared in the examination and in the result declared she found her names as successful candidate. The petitioner was informed by the respondent No. 5 for counselling and accordingly, she appeared in counseling and produced all the documents for its verification, but thereafter no appointment order in favour of the petitioner was issued by the respondents, whereas appointment orders to other candidates of Science category were issued. The petitioner made representation on 17.3.2010 (Annexure P-5) which yielded no result and thus the petitioner has filed the instant writ petition, seeking a direction to the respondents No. 4 and 5 to conclude the proceedings of selection and issue appointment order accordingly to the petitioner.

(3.) Learned counsel appearing for the petitioners submits that the petitioner has been found successful in the examination, her documents have also been duly verified and as such, there is no reason to deny appointment to the petitioner for such a long time. Non-appointment of the petitioner and at the same time, issuing order of appointment to the candidates of other category is arbitrary, discriminatory and violative of Articles 14 and 16 of the Constitution of India.
