THE petitioners, who are claiming to be temporary process servers, seek a direction to the respondents to consider them for appointment on the post of regular peons, pursuant to the order dated 08.03.2010 (Annexure P/5), whereunder, several posts in class IV category, have been sanctioned by the State Government, for appointment in various districts. It is further sought that preference should be granted to the petitioners for appointment on the regular post of peon on the basis of their experience of work on the temporary posts. By order dated 24.08.2011, by way of amendment the petitioners were permitted to challenge the order dated 16.03.2011 (Annexure P/12) whereunder appointment of 41 persons have been made on class IV posts.

THE facts, in brief, as projected by the petitioners are that the petitioners were initially appointed as temporary process servers for a period of six months upto 30.06.2010 by order dated 25.03.2010 (Anexure P/1). Before that, they were appointed earlier also for a period of six months in the year 2007 and 2009. THE petitioners have also worked in the year 1998, 2000 and 2001 for a period of six months as temporary process servers. By order dated 08.03.2010, 42 posts were sanctioned for appointment in class IV category in District Surguja. According to the petitioners, the posts sanctioned were for appointment on the post of Process Server. THEreafter, the petitioners made a representation to the Collector, dated Nil (Annexure P/6) received on 08.06.2010.

ON perusal of the order dated 08.03.2010 (Annexure P/5), whereby sanction was granted for appointment on 42 posts under Class IV category, it was observed that the appointment must be made in accordance with the recruitment and promotion rules and also the instructions issued by the State Government, time to time.
