(1.) The petitioner has filed the writ petition under Art. 226 of the Constitution of India mainly contending that she is widow and belongs to Schedule Caste and residing at Bilaspur with her son. Respondent No. 6 is chasing her and also assured her that he will solemnise marriage with her. But she has refused to marry him. Respondent No. 6 has used her name for getting house under the Pradhan Mantri Awas Yojna. Respondent No. 6 has attempted sexual intercourse with her on 7/12/2020. Thereafter, she escaped on the intervention of her uncle father-in-law. She has submitted complaint to the City Superintendent of Police, Civil Line Bilaspur on 8/12/2021 as well as to the Inspector General of Police (Scheduled Castes and Scheduled Tribes), Raipur on 26/12/2020, to the Superintendent of Police on 7/1/2021 and to the Inspector General of Police, Bilaspur on 17/3/2021 narrating the incident took place with her and the conduct of respondent No. 6, but no action has been taken on her compliant by the police authorities.
(2.) On that factual matrix, she has filed the writ petition (criminal) and prayed that F.I.R. be registered against respondent No. 6 for the offence punishable under Sec. 376 of the IPC and 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
(3.) From perusal of relief sought, it is quite clear that petitioner wants that on the basis of complaint, FIR be registered against respondent No. 6.
