(1.) The applicant has with preferred this application for grant of bail as he is arrested in connection with Cr.No. 194/05 registered in Police Station -Gorela Distt. Bilaspur for the offence punishable under Sections 420, 487, 468, 471, 408, 409 of the IPC and Section 3/7 of the Essential Commodities Act.

Having heard learned counsel for the parties, having regard to the facts and circumstances of the case, considering that the only allegation against the applicant is that the happened to be the friend of Secretary. Panchayat namely Rajkumar Sharma, who was entrusted with 255 quintals of rice for the purposes of distribution to fair price shops under Public Distribution Scheme, and according to prosecution case, the applicant was instrumental in advising the Panchayat Secretary to dispose of the rice to some private agency, I am of the opinion that present is a fit case where the applicant should be released on bail. Accordingly, the application is allowed. It is directed that in the event of applicant's executing a personal bond for a sum of Rs.10,000/- with one surety for the like amount to the satisfaction of the concerned trial Court, he shall be released on bail. He shall appear before the trial Court on each and every date given to him till disposal of the trial.
