JUDGEMENT

(1.) By this petition, the petitioner seeks a direction to the respondent authorities to consider the case of the petitioner for appointment on the post of Shiksha Karmi Grade-Ill.

The indisputable facts, in nutshell, for disposal of the case, as projected by the petitioner, are that pursuant to the advertisement dated 13-1-2008 (Annexure P-l) issued by the Chief Executive Officer, Janpad Panchayat, Masturi (Bilaspur), the petitioner along with other candidates applied for the post of Shiksha Karmi Grade-Ill. On verification of the testimonials of the petitioner, an admission card (Annexure P-2) was issued by the authorities and the petitioner was permitted to appear in the written examination. After succeeding in the written examination the petitioner was called for counselling by letter dated 17-6-2008 (Annexure P-4). However, all of a sudden by letter dated 23-6-2008 (Annexure P-5) the fourth respondent intimated the petitioner that he could not be appointed on the post of Shiksha Karmi Grade-Ill on the ground that he was not in possession of D.Ed, certificate. Being aggrieved by the aforesaid action, the petitioner submitted a representation dated 16-1-2008 (Annexure P-6) before the respondent authorities, but the same has not been considered and decided till date. Hence, this petition.

(3.) Shri Rajput, learned Counsel appearing for the petitioner, would submit that the action of the respondent authorities is illegal, arbitrary and against the principles of natural justice. After completing the entire selection process, the petitioner cannot be deprived from the benefit of granting appointment on the post of Shiksha Karmi Grade-Ill only on the ground that he is not in possession of D.Kd. certificate, when the petitioner is in possession of the B.Ed, certificate.
