(1.) Heard the learned counsel for the petitioner and the learned Additional Government Advocate.

The matter was heard on several dates with regard to the eligibility of the petitioner to secure recognition as a 'local person' and thereby enable the petitioner to harvest the benefits conferred on such person by the provisions of Article 371-J of Constitution of India, which came to be introduced into the Constitution for the purpose of conferring benefits in the matters of education and employment in respect of persons who hail from the said area otherwise known as Hyderabad-Karnataka area including the Districts of Kalaburgi, Bidar, Bellary, Koppal, Raichur and Yadagiri.

That the petitioner's application to be recognized as local person and eligibility certificate to enable her to seek admission on the said basis in the examination to be conducted by the Karnataka Examination Authority, which conducts the common entrance test for admission to the colleges imparting professional education. The claim of the petitioner was based on the premise of birth certificate and the said application came to be rejected, that the petitioner would not qualify on the ground of her birth alone and hence, the instant writ petition.
