JUDGEMENT

(1.) Though respondents 5 and 6 are served, they have remained unrepresented.

(2.) The petitioner is the widow of Basavaraj Magi who was working as a part time temporary JODC (Job Oriented Diploma Course) worker/teacher in Sericulture Trade initially with the 4th respondent- Deputy Director, Pre-University, Department of Education at Dharwad and later with the 5th respondent-SSS Pre-University College, JODC Department, Shirol, Gadag district and rendered service for 18 years.

It is the contention of the petitioner that the respondent-State Government passed a resolution known as Karnataka Merger of Part Time Job Oriented Course Employees Act, 2011, (for short 'the Act') which was notified in the Official Gazette on 06.04.2011. The said Act enabled merger of such part time and temporary teachers who had put continuous five years of service and as such, they would be treated on par with the government employees in order to get pension and pensionary benefits.
