JUDGEMENT

(1.) This petition has been filed by the petitioners/accused Nos. 2 to 7 under Section 438 of Cr.P.C. for grant of anticipatory bail in Crime No. 13/2019 (CC No. 337/2019) of Malamaruthi Police Station for the offences punishable under Sections 143, 147, 498A, 304B r/w Section 149 of Indian Penal Code and also under Sections 3 and 4 of Dowry Prohibition Act.

(2.) I have heard the learned counsel Sri. Raviraj C. Patil, appearing for the petitioners and Smt. Seema Shiva Naik, learned High Court Government Pleader appearing for the respondent-State.

The factual matrix of the complaint are that a complaint was filed by the mother of the deceased alleging that her deceased daughter Jyothi has completed her M.A. Degree and on 8.5.2016 marriage was performed with accused No. 1. Thereafter, she went to matrimonial home and were residing at Bengaluru and they led happy marital life for a period of three to four months. Thereafter, accused No. 1 started ill-treating and harassing for small issues and when they were residing in Bengaluru she gave a cot, fridge, Rs. 20,000/- cash and other essentials of the house and in the month of December 2017 as she was pregnant, seemantha was performed and thereafter she has been brought to Dandeli. At that time accused No. 1 along with his parents visited two to three times and the husband did not take his wife to the hospital for treatment and has not asked about her health. It is further alleged that when she has come for delivery, accused No. 1 used to demand money for his necessities and she paid Rs. 50,000/- cash for purchasing the car. The deceased delivered a female child on 8.3.2018 and thereafter as she has delivered a female child the accused did not come and saw the child and his wife. It is further alleged that the accused persons called over the phone and asked to pay Rs. 10 Lakhs for purchase of a site at Bengaluru and a Panchayat was held in this behalf and they advised to look after well and after six months the accused and his parents took her to Belagavi to the house of his parents and again there they have ill-treated and harassed and demanded Rs. 10 Lakhs and on 28.1.2019 she committed suicide by hanging at about 2.30 p.m. On the basis of the complaint a case has been registered.
