(1.) The present appeal has been preferred by the respondent-wife aggrieved by the order dated 20.06.2005 passed by the Court of Civil Judge (Sr.Dn.) & C.J.M., Gadag in M.C.No.41/2003 allowed the petition filed under Section 13(1)(1b) of the Hindu Marriage Act, 1955 and the marriage was dissolved.
(2.) We have heard learned counsel for the appellant as well as the respondent-legal representative of the deceased Arjun, husband of the appellant.

Facts leading to the case are that appellant got married with the deceased respondent in the year 1991 and as the appellant was not intended to continue the wedlock with respondent, the deceased respondent husband filed a divorce petition in M.C.No.41/2003. The trial Court got issued notice through paper publication in Nagarik Kannada daily newspaper and placed the respondent-appellant exparte and after recording the evidence of the petitioner-husband allowed the petition and granted the dissolution of the marriage.
