SRI RUHULLA KHAN Vs. STATE OF KARNATAKA

JUDGEMENT

(1.) The present petition has been filed by petitioner-accused under section 438 of Cr.P.C , 1973to release him on bail in Crime No.285/2018 of Sira Police Station for the offence punishable under Section 379 of IPC.

(2.) I have heard the learned counsel for the petitioner and the learned High Court Government Pleader.

(3.) The gist of the complaint is that on credible information on 20.07.2018 at about 4:30 p.m., the complainant went near Kote Maramma Temple in Sira town and there he noticed that in an unnumbered tractor-trailer sand was being transported. By seeing the police the driver fled away from the spot and tractor-trailer was seized with sand and a case was registered.
