JUDGEMENT

(1.) The present petition has been filed by the petitioner-accused No.2 to release him on regular bail under section 439 of Cr. P.C , 1973for the offence punishable under Section 302 read with Section 34 of IPC in Crime No.516/2017 of Tunganagar Police Station, Shivamogga District.

(2.) I have heard learned counsel for the accused-petitioner and the learned High Court Government Pleader for the respondent-State.

(3.) The gist of the complaint is that the deceased Revathi got married to accused No.1 and within two days after the marriage, deceased Revathi was not found in the house of her husband and she came back to the house of her parents and there they came to know that the said Revathi was having love affair with the deceased Vijay and the matter was pacified by holding the Panchayat and the deceased Revathi was taken back. Again when Revathi left her matrimonial house without informing a police complaint was also filed about the missing of Revathi. Later, accused No.1 came to know that the complainant's son is having affair with the said Revathi and after that the complainant's son and others were intending to proceed but, at that time, the son of the complainant received a call and by informing that he will come on bike, he left on the motor bike at about 3.00 p.m. Subsequently, at about 4.00 p.m., one Manikanta informed the complainant that on the way to Shivamogga at N.R.Puram, in the middle of Santhekaduru and Vaddinakoppa village, on the road side the complainant's son Vijay and Revathi were found murdered. Thereafter he filed a complaint. After investigation the charge sheet came to be filed.
