JUDGEMENT

(2.) One Tammangouda Patil and Hanumanthgouda Patil were the brothers. The petitioners are the legal representatives of Hanumanthgouda Patil and respondents are the legal representatives of Tammangouda Patil.

(3.) Tammangouda filed O.S. No. 33/1958 before the Civil Judge Senior Division, Belgaum for partition and separate possession of his share in the suit properties. The said suit came to be decreed on 11/2/1961. The defendants unsuccessfully challenged the same up to this Court in appeal.
