JUDGEMENT

(1.) Heard counsel for the petitioner and learned HCGP. Perused the records.

(2.) On the basis of the complaint filed by District Health Officer of Tumakuru District, the police have registered the case at Crime No.82/2018. The allegations are that on 14.09.2018, the complainant and the squad visited Baraguru Village, Sira Taluk and they noticed that the two clinics namely Imran Baba Clinic and Rajashekar Banashankari Clinic at Baraguru were closed. Despite the directions issued to these petitioners, they have not taken valid licence under the Karnataka Private Medical Establishment Act, 2007 and have not registered under the said Act. These petitioners are practising medical profession in their clinics without holding the proper qualifications. On these allegations, the police have registered the case.

(3.) The counsel for the petitioners submitted that the proper procedure prescribed for initiating the proceedings against the petitioners is not followed as per Sec. 19A of the KPME Act, 2007. Therefore the complaint filed against the petitioners is not in accordance with law.
