JUDGEMENT

(1.) THE appellants were defendants in O. S. No. 4587/93 on the file of the VIII Additional City Civil judge and Sessions Judge, Bangalore. The suit was instituted by the 1st respondent herein for the following reliefs:

(2.) THE suit property is described as 3 bedroom apartment (flat) bearing No. 8, situated in the 8th floor with covered car parking space in the ground level at Hoysala Apartments, cunningham Crescent, Bangalore-560 052. The approximate built area is - 1605 sq. ft.

(3.) ACCORDING to the plaint averments, the defendants-1 and 2 are the joint owners of flat no. 808 along with car parking place at hoysala Apartments, Cunningham Road, bangalore. They had purchased the same from the 4th defendant- M/s. Mukund Constructions Company on 30-8-1991 and since then defendants-1 and 2 are in possession of the property.
