(1.) The petitioner is a candidate in the election for the office of the President of the third respondent Century Club. His prayers are as follows:
(2.) Sri B. Shekarappa, the learned counsel for the petitioner submits that he is not pressing prayer (b). He submits that the petitioner and the respondent No.5 are the candidates in the election for the post of President. He submits that the respondent No.5 is violating the code of conduct and soliciting the votes. He read out the relevant Rules and Regulations of the third respondent Club. They are extracted hereinbelow:
(3.) He submits that on the issuance of the calendar of events, dated 10.5.2017 (Annexure-A), the respondent No.5 has got inserted his message in the third respondent's News Letter. He submits that the said message is circulated after the coming into force of the calendar of events. He submits that the petitioner has lodged a complaint with the respondent No.4, who is the present President of the Club and also the Returning Officer. Without examining the veracity of the issues raised by the petitioner, the respondent No.4 sent a summary communication to the effect that the respondent No.5 has not committed any willful contravention. Thereafter the petitioner has also submitted the representation, dated 9.6.2017 (Annexure-G) to the second respondent Deputy Registrar of Co-operative Society. He submits that under Section 25 of the Karnataka Societies Registration Act, 1960 ('the said Act' for short), the Registrar of the Society is bound to hold the enquiry in the matter. But the respondent No.2 is showing total inaction in the matter.
