JUDGEMENT

(1.) Though the appeal is listed for orders, with the consent of learned counsel on both sides, it is heard finally.

(2.) This second appeal is filed by Karnataka Neeravari Nigam Limited (hereinafter, referred to as "the Neeravari Nigam") and the Assistant Executive Engineer, Lift Irrigation, Sub -Division No. 2, Naviluteerth (Dam Site), Saundatti Taluk, Belgaum Dist, who was defendant No. 1 in O.S. No. 87/2007.

(3.) For the sake of convenience, the parties shall be referred to, in terms of their status before the trial Court.
