JUDGEMENT

(1.) The petitioners' prayers are as follows:

(2.) Sri L.Rajanna, learned counsel for the petitioners submits that Goddess Maramma's Jathra Mahothsava was abandoned about 35 years ago. If it is revived now, it would create serious law and order problem. He submits that the respondent Nos.5 to 8 have stated in the caveat petition filed in the suit proceedings that they want to hold the celebrations at any cost. He submits that under Section 65 of the Karnataka Police Act, 1963 it is the duty of the Police officer to prevent the commission of offence. He insists that the Police and revenue authorities must convene a meeting of the villagers to find out an amicable solution, which is acceptable to all the villagers to perform the Jathra Mahothsava of Goddess Maramma.

(3.) Sri R.B.Sathyanarayana Singh, learned Additional Government Advocate appearing for the respondent Nos. 1 to 4 submits that Goddess Maramma's Temple is not a muzarai temple; it is a private temple. He submits that the dispute being raised herein is of civil nature.
