(1.) Heard the learned counsel for the petitioners and the learned Government Pleader for the respondent - State.
(2.) The present petitioners are arraigned as accused Nos.4 and 5. It transpires that one Yeshoda had married Kanakaranu - accused No.1 and their marriage was solemnized on 21.5.2015 and her dead body was found with hands and legs tied, in a gunny bag on the banks of Varada river near Honkana Village, Hanagal Taluk. It transpires that the deceased was in her matrimonial home as on the date of her death. The complainant having noticed that his sister was missing and after her dead body was discovered, he had filed a complaint of an unnatural death of his sister. The petitioners were allegedly not found on the date of the complaint. It is further stated that the accused had demanded dowry at the time of the wedding and had received cash of Rs.2,50,000/ - and 8 tola gold and a huge amount was spent on the wedding function. It is further alleged that the deceased was constantly harassed by the accused together, and they were ill -treating her and ultimately on the voluntary statement of accused No.3, the brother -in - law of the deceased, it was revealed that he had committed the murder of the deceased with a knife along with other accused who assisted him in killing and dumping her dead body as already stated.

In this background, on further investigation and on the incriminating material, the knife used for commission of the murder having been seized, the court below has taken a strict view of the role of the present petitioners as well. Though the allegation is that the petitioners even though had left the village after the wedding on 21.5.2015, they had actively conspired in committing the murder of the deceased and it is in this background that the petitioners' application for bail has been rejected by the court below.
