(1.) Heard the learned counsel for the petitioner and the learned Government Pleader.
(2.) The present petition is filed seeking bail on the ground that the petitioner has been accused of offences punishable under Sections 366A and 376 of the Indian Penal Code, 1860 and Section 6 of the Protection of Children from Sexual Offences Act, 2012.
(3.) According to the petitioner a case has been registered for offences stated as above on the basis of one Ramappa, the father of Gowthami had alleged that his daughter was a second year PUC student studying in Government Junior college, Doddaballapur and he had stopped sending his daughter to college since six months. However, on 16.02.2016 Gowthami had left home informing that she was going to visit Doddamma temple and never returned and therefore he had lodged a missing complaint with the police on 16.02.2016 at about 10.00 a.m. Said Gowthami was found in the company of the petitioner in Doddaballapur town and jurisdictional police had arrested them and brought them to the police station and on enquiry it was learnt that she was in the house of one Thirumalesha who was said to be the brother -in -law of petitioner and petitioner has slept with her and had sexual intercourse with her on more than six occasions. On the basis of the said allegation the petitioner has been booked for the offences as aforesaid and the statement of Gowthami was also recorded and the medical examination on both of them was also carried out and it is thereafter that the petitioner has been remanded to judicial custody. The petitioner has thought fit to approach this Court directly seeking bail and the learned counsel for the petitioner submits that since this Court has concurrent jurisdiction there is no bar in filing such an application.
