(1.) This petition is filed by accused No.6 under Sec. 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred as to 'BNNS') seeking grant of bail in crime No.102/2025 of Banashankari P.S, Bengaluru for offences punishable under Ss. 310(2) and 311 of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred as to 'BNS') pending on the file of II Additional Chief Judicial Magistrate, Bengaluru.
(2.) Heard learned counsel for the petitioner and learned HCGP for the respondent - State.

In the first information report (hereinafter referred as to 'FIR') it is alleged that when first informant and his friends were in the room No.201 of BVK club, Banashankari 2nd stage, Benagaluru at that time five persons wearing mask entered their room and they were holding chopper and long choppers and out of them one assaulted Sri. Anand from the back of chopper on his hand and they held others and robbed Rs.10,00,000.00 cash, 700 grams of golden ornaments and mobile phones. FIR is registered against six unknown persons. Investigation is still in progress. The offences alleged against the petitioner is a heinous offence. There are other accused who are absconding. If the petitioner is granted bail there are chances of hampering the investigation and threatening the witnesses. The charge sheet is yet to be filed. Hence, the petitioner is not entitled for grant of bail. In the result the petition is dismissed. The petitioner is at liberty to file bail application before the Sessions Court after filing of the charge sheet.
