The management of Nagori Vyavasaya Seva Sahakari Sangha, Niyamitha, Nagori, which is a co-operative institution functioning under the provisions of the Karnataka Co-operative Societies Act ('the Act'for short) has questioned the legality of the order of the Labour Court, Mangalore, made on an application presented to it under Sec. 33-C(2) of the Industrial Disputes Act directing payment of full salary to the 1st respondent during the period he was placed under suspension.

Learned counsel for the petitioner contended that under Rule 18 of the Karnataka Co-operative Societies Rules, 1960, power was conferred on the petitioner to place an employee of a co-operative society under suspension and there was no obligation in the statutory rules for payment of subsistence allowance and therefore the order of the Labour Court directing payment of wages was bad.
